Seller Disclosure Statements
Under Queensland property laws, sellers of residential property are required to provide buyers with a Form 2 Seller Disclosure Statement before a Contract of Sale is signed.
A Form 2 Seller Disclosure Statement is an important legal document that contains prescribed information about the property being sold. The purpose of the disclosure is to ensure buyers are provided with relevant information about the property prior to entering into a legally binding contract.
The disclosure documents may include information relating to matters such as:
- Title searches
- Registered encumbrances or easements
- Pool compliance information
- Council and zoning information
- Notices or orders affecting the property
- Body Corporate information (where applicable)
- Other prescribed certificates and searches required under Queensland legislation
Failure to provide a compliant Seller Disclosure Statement, or providing inaccurate or incomplete disclosure, may give a buyer certain rights to terminate the contract in some circumstances.
At Royal Conveyancing, we assist sellers and real estate agents with the preparation of Form 2 Seller Disclosure documentation to help ensure the process is completed accurately, efficiently and in compliance with Queensland legislative requirements. Our team works closely with sellers and agents to obtain the necessary searches and certificates so contracts can be prepared and issued promptly.
